The principle of retroactivity of the lex mitior represents one of the cornerstones of modern criminal law, recognized in numerous international treaties. However, while the non-retroactivity of unfavorable criminal law is an absolute and mandatory principle, retroactivity in mitius is considered subject to constitutionally legitimate limitations and exceptions, when supported by objectively reasonable justifications. This diversity of treatment raises profound questions that the contributions in this volume address from a multidisciplinary perspective that brings together issues of legal philosophy, constitutional law, criminal law, international human rights law, European Union law, and tax law.
