The paper traces the quantitative and qualitative evolution of the safeguard principles in criminal law, questioning the actual differentiation between the principle of non-retroactivity of unfavorable laws and the principle of retroactivity of favorable laws. It then proceeds to analyze the various rationes underlying the principle of retroactivity in mitius, ultimately criticizing the thesis that this principle is derogable. This is because derogations based on alleged overriding competing interests would, in reality, result in the instrumentalization of the individual for the purposes of general deterrence, thereby constituting an arbitrary and oppressive exercise of punitive power.
