What is a constitution? This question has been a recurring theme in Western political and legal thought even before the period of liberal revolutions. In the sections of this chapter, we will attempt to answer the aforementioned question in the work of each of the authors who, in our view, have been decisive in shaping Western political and legal thought: Burke, Lassalle, Marx, Hauriou, Kelsen, and Schmitt. The seemingly “arbitrary” nature of this selection is mitigated by the fact that several authors designate this list as a minimum list of thinkers responsible for what are conventionally called theories of the constitution.
