Ordinamento nazionale, sussidiarietà e approccio procedurale: brevissimi spunti introduttivi ad una lettura critica

This contribution includes some critical introductory reflections on the relationship between national legal systems and the ECHR, focusing on the complementary roles of the principles of legality and subsidiarity in the case-law of the ECtHR. It contends that subsidiarity should function as a principle of shared responsibility and coordination, without undermining the central role of the ECtHR as the ultimate guarantor of the Convention rights and freedoms.
