L’impatto della CEDU sui diritti dei migranti in Italia: tra elusioni dell’esecutivo e protezione giurisdizionale

This chapter explores the impact of the European Convention on Human Rights and the case-law of the European Court of Human Rights in the field of migrants’ rights on the Italian legal system, focusing on the principle of non-refoulement, the prohibition of collective expulsions, the deprivation of personal liberty in border procedures, and the protection of migrants’ private and family life. It highlights the ambivalent nature of this impact. On the one hand, domestic courts – most notably the Court of Cassation and the Constitutional Court – have shown a marked ability to internalise and, at times, further develop human rights, thereby ensuring effective protection in individual cases. On the other hand, a sometimes deferential stance adopted by the European Court of Human Rights toward State interests has contributed to a limited capacity to curb evasive practices implemented by the Italian executive. The resulting framework is one of uneven protection, where the effective enjoyment of rights depends largely on judicial intervention, against the backdrop of a lack of comprehensive legislative adjustment and the persistence of unlawful administrative practices.
