The sports justice system, wich has undergone major interventions in parallel with the sector’s marked financial grows (starting with football), has evolved from its original private sector configuration towards a public sector dimension that would like to replicate the stylistic features of the criminal process. The heavy codification, however, does not seem to be reflected in the decisions of the sports bodies, wich show a tendency towards a move in favour of the principle of private autonomy. This approach, especially in the disciplinary field, leads to: a) the frequent use of the principle of sporting fair play as a sanction; b) the bias of the investigation in favour of the accuser. The media distortion of the special trial exacerbates the trend and brings the justicial function closer to politics (when not to ethics) than to law. This drift should be fought against, on pain of the loss of the very juridical nature of sport and, by extension, of its autonomy. The paper tries to identify some normative and operational lines of action.
