The paper deals with the ECHR’s Verein KlimaSeniorinnen Schweiz et al. v. Switzerland judgment, with regard to the principle of separation of powers, i.e. the role of policy makers and judges in climate issues. The decision constitutes a leading case and recognizes the existence of a double margin of appreciation for political actors in climate matters, depending on the consideration of the objectives or the means to achieve them. In other words, the States’ appreciation is not unlimited, and judges (including the ECHR) have a complementary role with respect to the decision-making process in constitutional democracies, also in accordance with the recommendations of the so-called Venice Commission in the matters of democracy, human rights and the rule of law.
