The paper investigates the structure of tort, and the obligation to compensate for the relevant damage, in the field of sport activities. On the grounds of the constitutional recognition of sport may derive the exclusion from liability for the injuring party when the damage has been caused by an action that is appropriate under a technical point of view when the characteristics of the sporting activity, the context and the features of the other parties are taken into account. Specific cases relating to extreme sports, contact sports and potential contact sports are examined. In this perspective, the favourable view by the legal system of sport as an activity is highlighted, due to the educational and social values it conveys and the physical and mental well-being of the individual it aims at ensuring. Sport strengthens the self-determination of the individual: accordingly, on the other side, the intervention of public authorities and the paternalism of the legislator are reduced in such area of collective interaction.
