The analysis of transnational constitutionalism, as proposed in this work, will begin with the idea that the assertion of the epistemological autonomy of comparative constitutional law over the past few decades allows us to use its concepts and, in particular, its methodologies to demonstrate the real and effective occurrence of a transnational phenomenon, especially a constitutional one. By also drawing on research from other fields of knowledge, such as history, philosophy, and political science, comparative constitutional law has been able to develop as a primary instrument both for promoting and developing the normative networks typical of transnational constitutionalism, and for critically analyzing these same normative networks.
