This chapter analyzes how American constitutionalism became responsible for the genesis of the notion of a constitution as the supreme legal document in a state legal order. In the 18th century, the idea of the Constitution as a political document limiting public power was introduced to Europe – notably following the French Revolution – but still without a clearly present legal dimension, that is, without the possibility of judicial review of normative acts.
