The paper examines the main controversial issues arising in Italy’s first climate litigation case – the so-called Giudizio Universale, decided at first instance by the Civil Court of Rome on 26 February 2024 – focusing on the attempt to frame the ‘climate claim’ against the State within the traditional categories of domestic law of obligations.
