Adattamenti imperfetti: un bilancio della prassi italiana in materia di riapertura dei giudizi interni a seguito di violazioni della CEDU

This contribution addresses the long-standing issue of the introduction of means to vacate domestic final judgments into Italian law, where this is necessary to ensure the enforcement of rulings of the European Court of Human Rights (ECtHR). Since the late 1990s, the ECtHR has come to indicate the reopening of domestic proceedings as “the most appropriate form” or “one of the appropriate forms” of restitutio in integrum. In Italy, the introduction of revocation instruments has taken place in very different ways and has not always been in line with Strasbourg case-law. Through an analysis of domestic rulings and normative reforms, the extent to which the Italian legal order ensures the reopening of criminal and civil proceedings, where appropriate, with a view to complying with the duty to organize the judicial system so as to ensure respect for the European Convention on Human Rights (ECHR) will be critically discussed. Attention will be devoted to those remedies which allow for the reopening of domestic proceedings based on a unilateral declaration by the respondent State recognizing its violation of the ECHR, namely, following a decision pursuant to Article 37 ECHR instead of a final judgment by the ECtHR. As Italian law and practice treat criminal and civil cases differently when it comes to such unilateral declarations, the contribution will eventually outline the implications on the ECHR plane.
