A unique political animal, the European Union has given rise to important constitutional conundrums and paradoxes that John Erik Fossum and Agustín José Menéndez explore in detail in this book. The authors consider the process of forging the EU's constitution and the set of fundamental norms that define the institutional structure, the decision-making procedures, and the foundations of the Union's democratic legitimacy. Their analysis illuminates the distinctive features of the EU's pluralist constitutional construct but also the interesting parallels to the Canadian constitutional experience and provides the tools to understand the Union's development, especially during the Laeken (2001–2005) and Lisbon (2007–2009) processes of constitutional reform.

Agustín José Menéndez is Lecturer of Jurisprudence and Political Philosophy and of the State at the University of León (Spain) and European fellow of ARENA, the Center of European Studies at the University of Oslo. He is the author of Justifying Taxes (2000), De la crisis económica a la crisis constitucional (2012) and co-editor of several volumes on the law and politics of the European Constitution, several of which with John Erik Fossum. In Italian, he has just published Una difesa (moderata) della sentenza Lisbona della Corte costituzionale tedesca (Edizioni Scientifiche, 2012).


John Erik Fossum is Professor in Political Science at ARENA Centre for European Studies, at the University of Oslo. He is co-editor of the Routledge Series on «Democratizing Europe»; is co-director of the research project «The Norwegian Constitution in a Changing European Context» (NORCONE); was co-architect behind and substitute coordinator for the 5-year integrated project «Reconstituting Democracy in Europe» (RECON 2007-11); is co-director of WP 2 of the 5-year project Eurotrans; is vice-president of the Nordic Association for Canadian Studies; and is president of ECSA Norway. He has published widely on issues related to democracy and constitutionalism in the EU and Canada. Recent publications include: E. O. Eriksen and J. E. Fossum (eds.), Rethinking Democracy and the European Union, Routledge, 2012.
