The principle of state sovereignty, as well as the still hegemonic presence of the state in international relations, requires us to analyze in this chapter how the three central concepts of modern constitutional theory can be made compatible, or not, with transnational constitutionalism. Territory, constituent power, and the unity of the legal system can be considered the concepts that define the objective dimension of modern constitutionalism, developed since the era of the great Western revolutions, as we have seen throughout the first part of this work.
