The essay addresses the issue of the difficult relationship between executive power and Independent Administrative Authorities from a historical perspective that takes into account the evolution of a model starting from the experience of the US legal system. The analysis, brought to the Italian context, develops by examining the problems connected to the independence of the Bank of Italy and the particular cases relating to the first authorities established between the Seventies and Eighties of the last century (such as Consob and Isvap). The overall picture that emerges, not only allows us to outline a mix of powers that sees the Authorities concentrating functions of a different nature, but also bears witness to a new and entirely particular public power. A power not tied to the traditional model of political direction and ministerial responsibility, but “dictated from below”, linked to the specific needs of each sector in which the authorities operate and to the need to guarantee freedom rights.
